RELEASE AND INDEMNITY AGREEMENT I, the above-named player, acknowledge that ice hockey is a contact sport and sometimes a dangerous activity that can result in physical injury or other damages. We AGREE that the Elias Community Sports, Inc. (the Elmira Impact), its’ officers, agents, servants, employees, coaches, scouts, volunteers, sponsors, facilities, rinks, and facility and rink employees shall not be liable to me or the above-named player for any injury or damage resulting directly or indirectly from any participation with Elias Community Sports, Inc., or due to the use of any equipment provided to me by Elias Community Sports, Inc. In consideration of Elias Community Sports, Inc. accepting the above-named player, we hereby acknowledge and agree that, to the fullest extent of the law, the undersigned will defend, indemnify, discharge, and hold harmless Elias Community Sports, Inc., and any of their officers, directors, employees, agents, affiliated organizations, subsidiaries, sponsors, and partners, from and against all claims, damages, judgments, liabilities, losses, and expenses, including attorney's fees, for any injuries or damages arising out of or resulting from the above-named player’s participation in any way with Elias Community Sports, Inc. or due to the use of any equipment or other items provided to me by Elias Community Sports, Inc. including without limitation any injuries or damages incurred during travel or travel related functions to or from any and all organization/team functions. We UNDERSTAND that this agreement shall bind my heirs, legal representatives and all assigns and shall inure to the benefit of Elias Community Sports, Inc., its’ officers, agents, servants, employees, volunteers and sponsors, and their successors and assigns. IT IS FURTHER AGREED that Elias Community Sports, Inc., does not and shall not be considered to guarantee or warrantee equipment as may be used in the conducting of said activity. Elias Community Sports, Inc., reserves the right to use any pictures or video taken during the activity for promotional or instructional purposes without compensation. Further, I acknowledge the contagious nature of the Coronavirus/COVID-19 and acknowledge that Elias Community Sports, Inc. cannot guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to Elmira Impact team staff, First Arena staff and other players. I voluntarily seek services provided by Elias Community Sports, Inc. and the Elmira Impact and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I hereby release and agree to hold Elias Community Sports, Inc. harmless and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act, or that may otherwise arise in any way in connection with any services received from Elias Community Sports, Inc. I understand that this release discharges Elias Community Sports, Inc from any liability or claim that I, my heirs, or any personal representatives may have against Elias Community Sports, Inc with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Elias Community Sports, Inc. This liability waiver and release extends to Elias Community Sports, Inc. together with all owners, partners, and employees.
